We advise domestic and international insurers and other insurance industry participants on a broad range of contentious and non-contentious insurance matters, including policy interpretation and coverage, reinsurance, D&O and management liability insurance, captive insurance, cyber insurance, product development, and regulatory matters.

We have particular experience in complex cross-border insurance matters and work closely with local counsel and other professionals in multiple jurisdictions. Our practice includes advising on significant insurance claims and coverage disputes, as well as representing insurers in subrogation claims, product liability matters and other insurance-related disputes. We also advise clients on regulatory inquiries and investigations, including matters involving Japan’s Financial Services Agency (FSA).

Insurance Coverage, Claims & Disputes

• Advising a major Japanese insurer on a substantial business interruption claim arising overseas, including the interpretation of English-language insurance policies and the scope of coverage for business interruption losses.
• Advising a major Japanese insurer on a corporate insurance claim arising from a major natural disaster overseas, working with local counsel on policy interpretation and coverage issues.
• Advising a major Japanese insurance group on coverage issues under a management liability insurance policy in connection with a damages claim against the Indonesian subsidiary of a Japanese company.
• Advising a major Japanese insurer on D&O insurance coverage issues arising from a damages claim against directors of the Thai subsidiary of a Japanese insured company.
• Advising a major Japanese insurer on an insurance claim arising from a factory accident involving a U.S. food manufacturer.
• Representing a major Japanese insurance group in a subrogation claim arising from a product liability incident.

Reinsurance & Insurance Transactions

• Advising a major Japanese reinsurance company on a long-term life reinsurance transaction involving amendments to an existing reinsurance arrangement and the entry into a new reinsurance agreement.
• Advising a major Japanese insurer on the use of a captive reinsurance structure.
• Advising a major Japanese insurer on the development and introduction of new insurance products utilizing telematics.

Product Liability & Claims Management

• Representing and advising a major Japanese insurance group in product liability disputes involving pharmaceutical products, electrical appliances and industrial equipment in Japan and the United States.
• Representing a U.S.-based insurance group in a product liability dispute involving an electrical device.
• Handling numerous consumer claims for a global technology company as part of TPA services.
